If you are planning to setup an appointment with a local salon, it is recommended that you first verify the professional or business license. You can do that online for the state of Montana by visiting ebiz.mt.gov. From there you can search for the person or business and see if there are any disciplinary actions on record. This will allow you to make an informed decision about the person and or business providing your service.

Filing a Complaint

Part of the duties of the Montana Board of Barbers and Cosmetologists is receiving and investigating consumer complaints involving unlawful acts which may include:

  • False advertisement
  • Violations of health
  • Deceptive statements
  • Sanitation regulations
  • Unlicensed person
  • Malpractice or incompetence

If you feel like you have experienced one of these issues listed above, or have information about a specific incident, then you would need to submit your complaint. If you have issues or questions about the complaint process outlined below, then it is recommended you contact the state board for assistance.

The Department is charged with regulating professions and occupations for the protection of the public as a whole. Although the Department does not represent individuals filing complaints, the Department will review complaints in a timely manner to ensure a complaint is processed and that the Board will take appropriate action. The length of time for resolution of a complaint is impossible to estimate due to the various complexities presented in individual complaints. The following types of complaints may be filed:

  • Unprofessional conduct by a licensee
  • Unprofessional conduct by a license applicant
  • Unlicensed practice of the profession or occupation

If an individual is unsure of what constitutes unprofessional conduct and needs a description of the various types, reference to Montana statutes and rules will provide an answer. You can download the complaint form by clicking here. Once you download it and fill it out completely, the next step is to drop it off or mail the complaint form to:

Montana Board of Barbers and Cosmetologists
301 South Park, 4th Floor
PO Box 200514
Helena, MT 59620-0514

The licensee receives a copy of the complaint in order that a response to the allegations can be made. The Screening Panel is a Closed Meeting. However, if the Board proceeds with disciplinary action, the Notice is a public document as are all subsequent legal filings. Hearing proceedings (if the licensee requests a hearing) are open to the public, as is the Adjudication Panel meeting.

Here are some tips on preparing your complaint. Make a list of things you want to say. Try your best to separate your feelings from the facts. Present the events in the order of which they happened, use dates and times if possible. When submitting your complaint, please make sure to provide copies of documents, for example contracts, letters, advertisements, sakes slips, cancelled checks, warranties and any other documentation that can support your claim. Only provide copies, keep the original copies for your own record. Please remember, the complaint should describe the event or practice which misled you. If you can, please also state why the practice was misleading.
